Claims for diseases caused by asbestos exposure, often diagnosed decades later, brought against solvent companies in court and against bankruptcy trusts set up by former manufacturers.

Mesothelioma, a cancer of the lining of the lungs, abdomen or heart, is strongly associated with asbestos exposure, and asbestos also causes asbestosis and lung cancer. These diseases typically appear decades after the exposure, so a claim depends on reconstructing a work and life history: where the person worked, which products they used or worked near, and who made, sold or installed them. Shipyards, construction trades, power plants, refineries, auto brake work and military service, particularly in the Navy, are common sources. Some states also recognize claims for secondary or take-home exposure, such as a family member who laundered a worker's clothes.
Many former asbestos manufacturers went through bankruptcy and were allowed to channel their asbestos liability into trusts that pay claims under published procedures, with the companies protected from suits (11 U.S.C. § 524(g)). An injured person can often file claims with several trusts and also sue companies that remain solvent in court. Because limitation periods for these diseases usually start from diagnosis or discovery rather than exposure, a recent diagnosis can support a claim for exposure long ago, but the period then runs quickly. When the person dies, the family may have wrongful death and survival claims.
Asbestos work today is regulated: OSHA sets exposure limits and work practices (29 C.F.R. §§ 1910.1001 and 1926.1101), and EPA rules govern asbestos handling during demolition and renovation (40 C.F.R. Part 61, Subpart M). Violations of those rules can be evidence in a current exposure case, but most claims arise from exposures that occurred long before.
After a diagnosis, write down every job, ship, base and worksite you can remember, the products and brand names you worked with, and the names of coworkers who can confirm them. Speak to a lawyer who handles asbestos cases promptly, because the limitation period usually runs from the diagnosis, and the claim may involve both court cases and several trust filings that need to be coordinated. Veterans should also ask about VA disability benefits, which are separate from any lawsuit.
Worried about the cost? A lawyer can be hired for one part of a case only (limited-scope representation), may be paid from what a claim recovers (contingency fee), or may be free through a pro bono program or legal aid; a court can also waive its own filing fees.
